Marcus specialises in handling construction-related claims Australia-wide for local and international insurers and their insureds as both coverage and defence counsel. He has acted for D&C contractors, building surveyors, architects and designers, engineers, and other construction professionals (and their insurers).
He has extensive experience in managing high-value and difficult litigated and unlitigated multi-party disputes, including many large-scale and high-profile construction cases involving complex projects.
Marcus adopts a strategic and commercial approach to managing and resolving difficult claims and is adept at marshalling and understanding complex technical evidence.
He also has claims handling experience gained through a 12-month secondment within the claims team of a major provider of construction PI insurance.
Marcus has been recognised for his expertise in Insurance Law, Product Liability Litigation, Professional Malpractice Litigation and Transportation Law in the 2025 Australian edition of Best Lawyers.
Marcus has practised extensively in tribunals and courts Australia-wide. He has also worked in London and Hong Kong.
- Defending various construction professionals such as architects / designers, engineers (including civil, structural, geotechnical, acoustic and fire), building surveyors / certifiers / inspectors, land surveyors, and project managers / superintendents, in design and defect claims, as well as in disciplinary proceedings.
- Advising insurers and their insureds regarding claims concerning major infrastructure and complex projects (including hospitals, education facilities, shopping centres, tunnels, cofferdams, mines, renewable energy projects and harbour facilities), as well as small and large residential, commercial and industrial property.
- Advising PI insurers on coverage regarding complex and high-value loss mitigation claims by Tier 1 design and construct contractors.
- Advising insurers as coverage, monitoring, defence and recovery counsel in respect of various systemic defect claims including with respect to cladding, corrosion, polypropylene piping, differential foundation movement, fire-stopping, concrete leaching, glazing, balustrades, and fire and life safety defects.
- Defending various design consultants and advising their insurers in relation to alleged defects in the flagship Sydney Light Rail project.
- Advising insurers regarding defects and delays in the design and construction of a mine.
- Defending plumbing contractors and consultants in proceedings brought by owners corporations in respect of various multi-unit developments.
- Successfully represented the contractor in the seminal Lacrosse litigation, from the time of notification (including initial proceedings before the Building Appeals Board) through to final orders before the Victorian Court of Appeal.
- Defending a consultancy firm named as a defendant to a $60 million class action arising out of the 2014 Mickleham–Kilmore bushfire.
- Handling and resolving substantial multi-million dollar portfolios of litigated and unlitigated cladding claims relating to various Tier 1 and Tier 2 contractors and buildings throughout Australia.
